Terms and conditions

These Terms and Conditions (the "Terms") govern access to and use of the Miscostosfijos platform (the "Service"), operated by TODOMIS SAS (Colombia, NIT 901.325.484-2) and TODOMIS SPA (Chile, RUT 78.172.757-1), depending on the country where the Service is provided to you ("Todomis", "Miscostosfijos", "we"). By creating an account or using the Service, the user ("you") accepts these Terms. If you don't agree, don't use the Service.

1. What Miscostosfijos is (and isn't)

Miscostosfijos is a financial management and pre-accounting platform: it organizes fixed costs, collections, quotes, reconciliation and cash-flow projection, and offers decision-support tools.

Miscostosfijos is NOT accounting software, an e-invoicer, or an accounting, tax, legal or investment advisory service. It doesn't file tax returns or official financial statements, and it doesn't replace your accountant, auditor, or your accounting software or e-invoicer. The information it provides is informational and for management support; decisions and their legal, accounting and tax compliance are the user's responsibility.

2. Definitions

• Service: the web platform, its modules, API and integrations.
• Account: the registration you use to access the Service.
• User: the person or company that uses the Service.
• User content: the data and documents you upload or connect.

3. Account and eligibility

You must register accurate information and keep it updated, be of legal age and have capacity to be bound. You are responsible for the confidentiality of your credentials and for your account's activity, including the users you invite and their permissions.

4. Plans, trial and payments

• We offer a free 7-day trial with no card.
• Plans are billed monthly in dollars (USD), with no lock-in; you can cancel anytime from the platform.
• Current prices are published on the pricing page and may be updated with reasonable notice.
• Taxes applicable to your jurisdiction may be added to the price.

5. Acceptable use

You agree not to use the Service for unlawful or unauthorized purposes; not to breach its security, integrity or availability; not to upload content that infringes third-party rights or applicable rules; and not to resell or exploit the Service without authorization. We may suspend or cancel accounts that breach these Terms.

6. User's tax and accounting responsibility

We operate in several LATAM countries, each with its own tax framework (for example NIT, RUT, RFC, CUIT, and invoice or CFDI schemes). Proper compliance with your accounting and tax obligations —as well as the accuracy of the information you upload— is your responsibility and that of your advisors. Miscostosfijos is a support tool, not a substitute for them.

7. Integrations and third parties

The Service may connect with third parties (e-invoicers, banks, messaging, payment gateways, AI tools). Use of those services is also governed by those third parties' terms, over which we have no control.

8. Personal data

The processing of personal data is governed by our Privacy Policy and our Data Processing Policy. Security is described on the Security page.

9. Intellectual property

The Service, its brand, software and content are the property of Miscostosfijos or its licensors. We grant you a limited, non-exclusive and non-transferable license to use the Service. You retain ownership of your User content and authorize us to process it only to provide the Service.

10. Availability

We strive to keep the Service available; there may be interruptions due to maintenance or causes beyond our control. Operational status is published on Service status.

11. Limitation of liability

The Service is provided "as is" and "as available". To the extent permitted by law, Miscostosfijos will not be liable for decisions made based on the platform's information, for lost profits, or for indirect or incidental damages arising from the use or inability to use the Service.

12. Indemnity

You agree to hold Miscostosfijos harmless against third-party claims arising from your misuse of the Service or breach of these Terms.

13. Termination

You can cancel your account whenever you want. After termination you may export your User content under the applicable retention policy.

14. Changes to the Terms

We may update these Terms. We'll publish the current version on this page with its date; continued use implies acceptance of the changes.

15. Governing law and jurisdiction

These Terms are governed by the laws of the country of the entity that provides the Service: Colombia if you contract with TODOMIS SAS, or Chile if you contract with TODOMIS SPA; without prejudice to the mandatory consumer-protection rules of the user's country of residence. Disputes will be submitted to the competent courts of that country, unless otherwise provided by law.
